Christensen v. Integrity Ins. Co., 709 S.W. 2d 724 (Tex. App.-Houston [14th Dist.] 1986, writ granted), rev’d, 719 S.W.2d 161 (Tex. 1986).
Mr. Eggleston represented Integrity Insurance Company in its suit against C, Diane Christensen and others alleging fraudulent insurance claims for property damage which occurred during hurricane Alicia in 1983.
Integrity Insurance Company brought suit in Harris County, Texas. Christensen subsequently brought a duplicate suit for bad faith against Integrity in California where Christensen was a resident. Christensen threatened an injunction in California to abate the prior Texas action. On behalf of Integrity, Mr. Eggleston obtained a Temporary Restraining Order and Temporary Injunction prohibiting Christensen from pursuing her suit in California. The Court of Appeals sustained the trial court’s temporary restraining order and temporary injunction. Ultimately, the Texas Supreme Court reversed the appellate court and the trial court and dissolved the temporary injunction.
However, as a result of these proceedings, discovery in the Texas lawsuit was completed and set for trial while the California case remained enjoined, ultimately resulting in a settlement of the case for Integrity.
