Breach of contract tried to jury.
E+B obtained a jury verdict in favor of its client, a boat manufacturer, following the trial of a dispute concerning payment and delivery of motors necessary for the production of a boat. The jury awarded our client actual damages and attorneys’ fees.
Breach-of-settlement agreement disposed via summary judgment.
E+B secured dismissal of claims against our client and an award of attorneys’ fees to our client in a case involving an alleged breach-of-settlement agreement. The ruling was upheld on appeal.
Loan default results in favorable agreed judgment.
E+B secured a judgment in favor of our client in a loan dispute in which our client sought to foreclose on commercial real estate that was security for the loan. The judgment awards our client liquidated damages and the right to foreclose.
Tax protest successfully tried.
The local appraisal district overvalued our client's property at over $63.5 million for property-tax purposes. After a trial to the court, we obtained a judgment re-establishing the appraised value of the property, resulting in a tax refund for our client of approximately $800,000.
