Eggleston + Briscoe assists our clients with probate, trust and estate administration, and guardianship matters. Our lawyers routinely represent executors, administrators, and trustees in all aspects of estate and trust administration. These aspects include the appointment and probate process, compliance with fiduciary duties, will contests, and a variety of other matters relating to the administration and settlement of the estate and/or trust. We also represent beneficiaries regarding their interest in estates and trusts. In guardianship matters, the firm is often engaged to assist in seeking or defending against a proposed guardianship. We also represent court-appointed guardians in all aspects of guardianship proceedings, including preparing inventories and accountings.

E+B represented the executor under a holographic will that was contested by a previous executor contending lack of testamentary capacity and/or intent, as well as fraud. After several days of contentious trial testimony, including evidence offered by handwriting experts, the case was settled by agreement of the parties.
